Dealing with Legalities When Starting up
Posted on April 2nd, 2008
In operating on your own, you must choose one of three forms of business. Your business can become a sole proprietorship, a partnership, or a corporation. We recommend beginning as a sole proprietorship unless your business faces the danger of being sued for damages, needs to establish independent contractor status with companies that require it, or you will be working with a partner, in which case you will probably want to incorporate. You should consult an attorney and an accountant, however, in selecting the best form for your business.
The name you select for your business is one of the most important decisions you will make, so once you’ve selected your name, you will need to register and protect it. If you are a sole proprietors and use a name for your business other than your own, you will need to register the fictitious business name with DTI or Department of Trade and Industry. If your business is a corporation, you will need to register to SEC or Securities and Exchange Commissionas well.
